These terms apply to contracts for Majerowicz Support Center between Majerowicz.com and the customer. Individual offers and data processing agreements prevail in case of conflict. Mandatory consumer rights remain unaffected.
2. Contract formation
A contract is formed by acceptance of an offer, explicit order confirmation, completion of ordering or activation of the service.
3. Service scope
Scope, storage, device or user limits, support and billing period follow from the service description, selected plan, offer and confirmation. Additional services require agreement.
4. Customer duties
The customer provides correct information, protects credentials, maintains suitable devices and internet access, respects third-party rights and promptly reports security incidents.
5. Fees, term and cancellation
The prices, billing periods, minimum terms and notice periods shown during ordering or in the offer apply. Cancellation may be submitted through the support centre or the cancellation page on this website.
6. Availability and maintenance
Continuous availability is owed only where expressly agreed in an SLA. Maintenance, updates and internet or infrastructure incidents may temporarily affect use.
7. Backup and recovery
The exact protection scope follows from the service description. Unless otherwise agreed, the customer remains jointly responsible for selecting data, statutory retention and appropriate recovery tests.
8. Liability
Statutory liability rules apply. Limitations do not apply to intent, gross negligence, injury to life, body or health or any other mandatory liability.
9. Privacy
The applicable privacy policy applies. Where Majerowicz.com processes data on behalf of a customer, a data processing agreement may be concluded.
10. Law and jurisdiction
German law applies, excluding the CISG, to the extent legally permitted. For merchants, legal entities under public law and special funds under public law, the place of jurisdiction is Pasewalk. Depending on statutory subject-matter jurisdiction, Amtsgericht Pasewalk or Landgericht Neubrandenburg is competent. Mandatory jurisdictions, particularly for consumers, remain unaffected.
